General Terms & Conditions
Article 1 – Application and Concept
BLACKOUT ROOM is a life-size escape game concept belonging to the company SAS BLACKOUT ROOM. These general terms and conditions of sale apply to any contract for the provision of a game room concluded between (1) any company of the SAS BLACKOUT ROOM group and (2) the users of the room, hereinafter referred to as "USERS", whether they have booked personally or are part of the team of the person who made the booking, hereinafter referred to as "THE BUYER". These conditions also apply regardless of the means of booking, whether made via the SAS BLACKOUT ROOM website, hereinafter referred to as "WEBSITE", or with SAS BLACKOUT ROOM staff. The gaming space made available to players is referred to as "ROOM" and the provision contract as "CONTRACT". The gaming session for which the BUYER books and pays on the WEBSITE is called "GAMING SESSION". SAS BLACKOUT ROOM reserves the right to modify or have modified all or part of these general terms and conditions of sale as well as the content of its WEBSITE (www.blackout-room.com), at its sole discretion, at any time and without notice. The general terms and conditions of sale of SAS BLACKOUT ROOM are available on the WEBSITE and may be freely consulted upon simple request to SAS BLACKOUT ROOM reception staff.
Article 2 – Booking
Access to SAS BLACKOUT ROOM facilities and services is exclusively by prior booking either on the WEBSITE www.blackout-room.com or with SAS BLACKOUT ROOM staff. The booking is made for a specific day and time, and is only valid for that time slot. Booking is subject to availability, which is updated in real time on the website. The booking will only be firm and final upon receipt by the customer of a confirmation email from SAS BLACKOUT ROOM. You are responsible for the accurate entry of your contact details in the online booking form. By submitting it you guarantee to SAS BLACKOUT ROOM that the details provided are true and accurate. SAS BLACKOUT ROOM cannot be held responsible for any data entry error or error in the choice of date and time on your part. Bookings may be rescheduled up to 7 days before the GAMING SESSION date depending on availability upon written request to contact@blackout-room.com. Within 7 days, no changes, cancellations or rescheduling are possible. Under no circumstances is a GAMING SESSION refundable.
Article 3 – Provision and Use of the Room
In accordance with the very principle of the game, SAS BLACKOUT ROOM grants USERS the right to occupy the ROOM for a maximum period of 60 (sixty) minutes. Occupation of the ROOM is for the sole and exclusive purpose of participating in a game organised by SAS BLACKOUT ROOM, which must be carried out in a team of 2 to 7 people maximum depending on the mission booked. USERS accept that the time spent in the ROOM shall be a maximum of 60 minutes, regardless of whether they have managed to find all the clues and solve all the puzzles or not. This is a fundamental aspect of the game. Similarly, USERS accept that the game may end before the 60 minutes are up, in particular if they have managed to find all the clues and solve all the puzzles in under 60 minutes, without this giving rise to any price adjustment or compensation. Admission to the ROOM is only possible upon presentation of the booking confirmation email (sent shortly after the payment process to the BUYER) and the BUYER's identity document. The complexity of the game does not allow USERS under 8 years of age to participate in the CURSED SORCERER and MECHANISATION missions. For each GAMING SESSION, 1 adult is required. In case of doubt about a USER's age, SAS BLACKOUT ROOM reserves the right to request proof of identity. USERS are required to maintain the ROOM and all its equipment in good condition and to use it in accordance with the authorised purpose. Any intentional damage or damage caused by unauthorised handling will be subject to re-invoicing. The USER is required to behave respectfully and comply with SAS BLACKOUT ROOM rules at all times. SAS BLACKOUT ROOM does not tolerate any form of violence or harassment and reserves the right to refuse entry accordingly. SAS BLACKOUT ROOM also reserves the right to refuse entry to anyone under the influence of alcohol or drugs. Due to the nature of the game, no recording may be made in the ROOM. The use of video and/or audio recording devices is strictly prohibited. SAS BLACKOUT ROOM expects its USERS not to disclose details of the game.
Article 4 – Pricing
The rates quoted by SAS BLACKOUT ROOM are in euros, inclusive of all taxes, taking into account the VAT applicable on the date of the order. The prices charged by SAS BLACKOUT ROOM are indicated on the WEBSITE. SAS BLACKOUT ROOM reserves the right to modify its rates at any time. Any BUYER will pay the amount corresponding to the rate in force at the time of their booking. In the event of USERS arriving late for a reserved SESSION, the ROOM must be vacated at the time specified in the original booking. SAS BLACKOUT ROOM reserves the right to refuse entry to USERS who are 15 minutes or more late. If fewer USERS turn up than originally planned, no price difference will be refunded. If more USERS turn up than planned, the price difference must be paid before participating.
Article 5 – Companies
This article concerns companies that have booked outside the website. The prices charged by SAS BLACKOUT ROOM are indicated on the quote and vary depending on the service agreed contractually. Payment may be made by cheque or bank transfer. A 50% deposit must be paid upon ordering. The balance is due no later than the day of the event. Cancellation 15 days or more before: 50% penalty or no refund if already paid. Cancellation between 15 and 7 days before: 50% penalty, no rescheduling. Cancellation less than 7 days before: 100% penalty, no rescheduling.
Article 6 – Right of Withdrawal
In accordance with article 121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for leisure activities that must be provided on a specific date or period. Consequently, no booking may be cancelled or refunded except in the event of cancellation solely by SAS BLACKOUT ROOM, in which case the full amount will be refunded.
Article 7 – Personal Data
THE BUYER is responsible for the accuracy of the information entered in the online booking form. THE BUYER agrees to receive commercial information from SAS BLACKOUT ROOM. SAS BLACKOUT ROOM undertakes not to transmit the personal data of its USERS to any company outside the SAS BLACKOUT ROOM group, except at the request of an authority empowered by law.
Article 8 – Safety
The USER undertakes to observe all safety measures given to them. Smoking inside the premises is strictly prohibited. Each USER undertakes to read and observe fire safety instructions and emergency exits. It is strictly prohibited to obstruct the emergency exits. The USER is aware that it is absolutely forbidden to bring any hazardous objects into the premises. Any damage to the ROOM due to abnormal use may give rise to re-invoicing.
Article 9 – Photos and Cameras
Photos of each team may be taken before or after the gaming session and may be used by SAS BLACKOUT ROOM on its website or social media. Each ROOM contains a video surveillance device enabling staff to follow the gaming session and guide USERS if necessary.
Article 10 – Ownership
All elements, texts, videos and images on the website www.blackout-room.com are the exclusive property of SAS BLACKOUT ROOM. Any reproduction is strictly prohibited.
Article 11 – Competent Courts
These general conditions and any contract concluded incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of French courts.
